Right of withdrawal

Consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed to his or her commercial or self-employed activity.

Right of withdrawal

You have the right to cancel this agreement within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you or a third party appointed by you, who is not the carrier, has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us (Atif Naeem & Simon Niklas Otto GbR, Schillerstraße 4, 63477 Maintal, e-mail address: info@icedup.eu) by means of a clear declaration (e.g. a letter sent by post, telefax or email) of your decision to cancel this contract. You can use the attached sample withdrawal form, which is not required. In order to preserve the withdrawal period, it is sufficient that you send the notification about the exercise of the right of cancellation before the expiry of the period.

Consequences of revocation

If you withdraw from this Agreement, we will have to refund to you all payments we have received from you, including the delivery costs (with the exception of the additional costs arising from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the date on which the notification about your revocation of this agreement has been received from us. For this refund, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for such refund. We may refuse the refund until we have received the goods back or until you provide proof that you have returned the products, whichever is earlier. You must return or deliver the goods to us immediately and in any case not later than within fourteen days from the date on which you inform us of the withdrawal of this contract. The deadline is observed if you send the goods before the expiry of the period of fourteen days. You will bear the immediate costs of returning the goods. They shall only be liable for a possible loss of value of the goods if that loss is due to a handling of them which is not necessary for the examination of the nature, characteristics and functioning of those goods.

Exclusion or premature expiration of the right of withdrawal

The right of withdrawal does not apply to contracts

- for the supply of goods which are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is relevant or which are clearly tailored to the consumers’ personal needs;

- for the delivery of goods which could quickly deteriorate or whose expiration date would be rapidly exceeded;

- for the supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the contract, but which may be delivered no earlier than 30 days after concluding the contract and whose current value depends on fluctuations in the market on which the entrepreneur has no influence;

- for the delivery of newspapers, magazines or illustrations, with the exception of subscription
contracts.

The right of withdrawal expires prematurely in contracts

- for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery;
- for the delivery of goods, if they have been inseparably mixed with other goods after delivery due to their nature;
- for the delivery of audio or video recordings or computer software in a sealed packaging, if the seal has been removed after delivery.
